“placestostayincardiff.co.uk” means Places to stay UK Limited registered number 08210022 of 145-157 St John Street, London, EC1V 4PW, United Kingdom. Placestostayincardiff.co.uk acts as a marketing agent and booking agent for the hotels and other service providers advertised on the website www.placestostayincardiff.co.uk (the “Site”).

By visiting and/or using the Site you are agreeing to these General Terms and Conditions, the Privacy Policy and the Terms of Use and Site Use (“the Terms”) and you expressly consent and agree to be bound by the Terms and all applicable laws and regulations that govern this Site and your booking and/or enquiry.

References to “accommodation providers” means the owner/providers of the rooms, hotels, apartments, villas, BnB’s (Bed and Breakfast) and other accommodation of any description featured on this website and “accommodation” means the accommodation including all facilities and services advertised on our website that we have advertised and/or agreed to arrange in connection with your confirmed booking.

Important information

Placestostayincardiff.co.uk acts as advertising agent and/or booking agent only in respect of all bookings we make on your behalf. We undertake no responsibility for and are not liable for the misrepresentations, breaches of statutory duty, breaches of contract, or negligence of any of the accommodation providers and other suppliers of services who advertise and sell their products and services through us. This means that in the event of you suffering personal injury, illness or death as a result of any act or omission of an accommodation provider or other supplier of services (or their employees or agents) or you having any complaint about the quality of the services provided or having any other complaint at all, your sole right of redress will be against the independent third party who provided such service and Placestostayincardiff.co.uk will be under no liability at all (whether in contract, tort or otherwise howsoever).

You accept that we have not in any way selected or assembled your travel arrangements for you. Your accommodation arrangements are not a package and do not fall within the meaning of The package Travel, Package Holidays and Package Tours Regulations 1992.

By proceeding to book accommodation and/or other services through the Site or directly with the accommodation providers, you accept that you will be entering into a contract with the accommodation provider on their standard terms and conditions. If they are provided, we will endeavour (but undertake no liability to do so) to make copies of the accommodation advertiser/provider’s terms and conditions available to you.

Except in relation to adverts allowing online booking through our site where we may act as an agent in order to facilitate payments to enable transactions between accommodation advertiser/provider and you the customer/holidaymaker, we have absolutely no involvement in the booking process or transaction.

You understand that we may not have conducted any quality or other checks on the accommodation providers and we make no representations about the suitability of the accommodation and/or services offered for sale through the Site. We do not warrant that we have conducted any inspection of the property. The inclusion or offering for sale of an accommodation and/or services by Placestostayincardiff.co.uk does not constitute an express or implied endorsement or recommendation by Placestostayincardiff.co.uk of such accommodation or services. We do not guarantee the accuracy of, and disclaim liability for any inaccuracies relating to the accommodation and services offered for sale through us. Advertiser shall be responsible for ensuring that it has all necessary rights, licences and authorisations to rent property. It is the sole responsibility of the Advertiser to be eligible to rent the property and the sole responsibility of the customer/holidaymaker to pay for the rental.

Nothing in these terms of use shall operate to exclude or limit the liability of Placestostayincardiff.co.uk for fraudulent misrepresentation or death or personal injury caused by our negligence.

Where you, or any of the people that you are booking on behalf of, are in breach of any of the provisions of these Terms or contravention of any laws or rights of a third party, we reserve the right to cancel your booking without refund or compensation in any way and recover from you any costs incurred as a result of your behaviour.

 

Site content, documentation and booking information.

Placestostayincardiff.co.uk may modify the content of the Site and/or Terms at any time, and such modification shall be effective immediately upon posting of the modified content and/or Terms on the Site and your continued use of or access to this website will be deemed to indicate your acceptance of the modified content and/or Terms.

All database rights, trade marks, copyright, and design rights in our site and in the material published on it belong to us, our licensors or our accommodation advertisers/providers.

Any information placed on the Site relating to accommodation advertised on the Site including, but without limitation, details of the accommodation, the availability of rooms at the accommodation, the price of the rooms, the facilities available at the hotel, any accreditations afforded to the hotel and/or any details relating to any other services advertised on the Site have been placed on the Site by accommodation and/or service providers who are independent businesses and are not agents or employees of Placestostayincardiff.co.uk or its affiliates. Such information does not constitute any advice or recommendation given by Placestostayincardiff.co.uk and Placestostayincardiff.co.uk shall not be held liable for inaccuracies or errors in the accommodation contents or any of its elements. These independent businesses provide the services in accordance with their own terms and conditions which may limit or exclude their liability to you. Placestostayincardiff.co.uk and its affiliates are not liable for any acts, omissions, breaches or negligence of any such independent businesses or any damages or expenses resulting from the aforesaid. Placestostayincardiff.co.uk and its affiliates are not liable for any refunds in the event of overbooking or force majeure or any other cause beyond their control.

You may download material from our site for the sole purpose of using our site, but you must not modify, transmit, republish, copy, pass off, save or link to any content or material on our site without our prior written consent.

How to book accommodation or other services

Simply search for your chosen destination and dates, select your preferred accommodation provider and contact them directly by means of the “Enquiry” option. Please ensure you carefully check the dates, the price, the destination and the accommodation provider details before proceeding with your booking.

To enquire about a making a booking or to make a booking through us you will be asked to submit personal information, about yourself such as your name, email address, telephone number and potentially credit card details (“Personal Information”). Whenever you provide such Personal Information to placestostayincardiff.co.uk, Placestostayincardiff.co.uk will collate and use such Personal Information in accordance with Placestostayincardiff.co.uk “Privacy Policy”, details of which are set out at the end of these Terms of use. Please read this in full before providing any Personal Information to Placestostayincardiff.co.uk.

Affiliates are third parties who, in agreement with Placestostayincardiff.co.uk distribute Placestostayincardiff.co.uk hotel rooms to their customers.

 

Age and responsibility

You warrant that you are 18 years of age or over and have legal capacity to use the Site and to create a legally binding contract.

You warrant that all personal information submitted during accommodation booking is correct and you accept financial responsibility for all transactions made under your name or account.

You hereby authorise Placestostayincardiff.co.uk to process all Personal Information about you and the persons named on the booking that has been obtained in connection with your booking. Personal information shall be deemed to include, but not be limited to: any telephone numbers, fax numbers, email addresses, addresses of residences, signatures, ID or passport copies, or any other information belonging to you or your group.

The Personal Information that Placestostayincardiff.co.uk  collects shall be obtained, processed and transmitted in compliance with European Directives 95/46 and 2002/58, as well as any other such legislation that substitutes, complements and develops it. For more information please refer to our Privacy Policy.

COTS(UK) /CRIBS (US) – please advise at the time of booking if you require a cot or crib, in order to give this information to the accommodation provider; however, we cannot guarantee this request will be met. Such request will be subject to availability and if the accommodation is unable to meet any such request, neither Placestostayincardiff.co.uk, nor the accommodation, will have any liability to you in this respect. This request may only be available at an additional cost unless otherwise expressly stated in the description of the accommodation provider, and if any additional cost is applicable this should be paid by you direct to the accommodation provider.

 

Confirmation

To confirm a booking and/or supply personal information for an enquire, you must be authorised to make the booking/enquiry by all persons named on the booking and their parent or guardian for all party members who are under 18 when the booking is made. By making the booking/enquiry, you are confirming that all persons named on the booking accept the Terms and that you will inform the other persons named on the booking/enquiry of the confirmation details and any other appropriate information. By making the booking you also become responsible for making all payments due under the booking.

Placestostayincardiff.co.uk will confirm your booking when made through us directly and issue you with an email confirmation, however when you book directly through a accommodation provider we will not send you a confirmation email and take no responsibility for any direct booking confirmations. The accommodation or other service provider with which you enter into a contract will take payment.

In the event that you call Placestostayincardiff.co.uk by telephone, or are called by Placestostayincardiff.co.uk regarding your booking, calls may be recorded for monitoring and training purposes. In the event of a dispute regarding a booking, Placestostayincardiff.co.uk  reserves the right to review any call information.

 

Force Majeure

Placestostayincardiff.co.uk will not be liable for any changes, cancellation, effect on your booking, loss or damage suffered by you or for any failure by the accommodation providers and/or Placestostayincardiff.co.uk to perform or properly perform any of our respective obligations to you which is due to any event(s) or circumstance(s) if the non performance is caused by force majeure. By way of example force majeure includes, but is not limited to, war, revolution, terrorist act, closure of borders, epidemic, natural catastrophe or other causes that seriously affect both parties and other unforeseeable causes beyond Placestostayincardiff.co.uk’s control.

 

Before you travel

Placestostayincardiff.co.uk is not liable for damages or losses that may result from travel to any particular destination. The British Foreign and Commonwealth Office helps travellers stay safe overseas. Check the FCO website at www.fco.gov.uk/knowbeforeyougo for the latest advice on conditions and general information concerning specific countries.

It is your responsibility to ensure you have the relevant travel and health documents before departure for the country you are visiting, which shall include, but is not limited to, any inoculations that may be required, ID’s and passport. Placestostayincardiff.co.uk  shall not be liable for any expense incurred resulting from your missing, incomplete or incorrect documentation or any non-compliance with requirements.

 

Your safety

Due consideration should always be given to the risks involved and the nature of advertisements and contracts transacted on the Internet. It is possible for direct contact between the accommodation advertisers/providers and the customer/holidaymakers not occurring and hence due care and judgement should be taken when using our site.

 

Insurance

You are strongly advised to take out adequate travel insurance prior to arriving in your destination. It is your responsibility to check you have adequate insurance cover. The insurance should cover, amongst other things, the cost of cancellation by you, personal losses, all medical costs and the costs of assistance including return to the UK in the event of an accident or illness.

 

Complaints or issues with your accommodation

In the unlikely event that you have reason to complain or experience any problems with your accommodation please inform the accommodation reception staff or management immediately, to enable them to take appropriate action.

 

Claims

Any contract for the rental of any accommodation listed on our site is directly between a customer/Holidaymaker and an accommodation advertiser/provider (each a “Booking Contract”) and we are not a party to that contract.  You acknowledge (In recognition of this) that any claim you may have that is in any way connected with a dispute you have with an Advertiser on our site must be brought directly against that Advertiser and not against us.  Where we may provide an online payment platform, giving you the ability to make online payments to Advertisers via debit card, credit card, PayPal or other payment options. We may change or withdraw such platform at any time without notice in our sole discretion.

Where we may provide the technical platform to enable such payments, we are not responsible for the payment solutions themselves and we still are not a party to the contract between you and the Advertiser. We are not responsible for any decision taken by a provider or PayPal to decline your payment, based on its risk assessment of you or that transaction. We are not responsible for any losses you suffer as a result of making an online payments to an Advertiser and you shall not hold us liable for any losses you suffer as a result of making an online payment to an Advertiser. If you require customer support in relation to an online payment, you should contact your provider or your bank or credit card provider or PayPal (as applicable).

You agree to totally indemnify and keep us indemnified from and against any and all losses, actions, claims, damages, proceedings, liabilities and expenses (including legal fees) suffered or incurred by us arising out of or in connection with your use of our online payment platform to make payments to Advertisers, this includes in particular any claims from any payment solution providers, PayPal or Advertisers resulting from your actions or omissions.

 

Our limitation of liability and responsibility

Placestostayincardiff.co.uk acts merely as an advertising service through which accommodation providers and agents can advertise properties to customers. We do not own nor have we inspected nor do we have any control whatsoever over any property listed on our site and we make no representations or warranties regarding any of the properties.

Placestostayincardiff.co.uk have no control over the capacity to make a booking by any accommodation advertiser/provider of accommodation on our site nor do we have any control over the accuracy of any advertisement or the capacity of any Accommodation advertiser/provider to make a booking with a customer. We do require advertisers of accommodation to advertise properties accurately, truthfully, and fairly  and we also take reasonable steps to remove advertisements from our site following any complaint.

Placestosatyincardiff.co.uk disclaim all responsibility and liability for any loss or damage (including personal injury) suffered or incurred by you or another party arising from:

(i)            the act or omission of the Advertiser or any failure of the Advertiser to perform or comply with any of the terms of the contract between the Advertiser and you, including a failure to provide the property on the requested date (whether due to a double-booking or otherwise), or a failure to provide the property in the condition or with the amenities that such property was advertised on our site;

(ii)           any loss of or damage to personal possessions at a property;

(iii)          any incident or occurrence which takes place at a property; or

(iv)         any reliance by any user of our site, or by anyone who may be informed of any of its contents, placed on any advertisement, commentary and other materials posted on our site by Accommodation advertiser/provider, or any error or mistake or inaccuracy contained in any statement, representation, description, or other information made about or in connection with a property listed on our site.

Although placestostayincardiff.co.uk will do our best to prevent intentional misuse of our site and the dissemination of harmful programs via our site, we will not be liable for any loss or damage caused by any intentional misuse of our site or the distribution of viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site.

If we are in breach of these terms or otherwise liable to you (including, without limitation, for our negligence), we will only be responsible for any direct damages or losses you incur that result from your use of our site up to the value of the fees (if any) that you have paid to us. We shall not be liable for any indirect losses or damages suffered by you. Our liability to you shall not in any event include business losses (which includes without limitation loss or corruption of data, loss of profits or contracts, loss of revenue, loss of anticipated savings in expenditure, or business interruption) as a result of our breach of contract or negligence or otherwise.

This does not affect our liability for fraudulent misrepresentation or if something we do negligently causes death or personal injury, nor any other liability which cannot be excluded or limited under applicable law.

 

Legislation and Courts of Jurisdiction

These Terms of Use are governed by law of England and Wales, and the courts of England and Wales will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site (although we retain the right to bring proceedings against you for breach of these Terms of Use in your country of residence or any other relevant country).  This agreement will be governed by English law and any disputes will be dealt with by the English courts. If however you booked your accommodation/holiday in Scotland or Northern Ireland any disputes may be dealt with in the local courts in Scotland or Northern Ireland and will be subject to the law of those countries.

You agree to comply with all applicable laws, statutes and regulations concerning your use of our site. Each and every booking carried out on, or as a result of use of, our site is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with the law of England and Wales.

 

If you cancel, amend or change a booking

If you cancel or amend your booking, there may be a cancellation charge or amendment fee levied by the accommodation or other service provider. In any event, if you fail to cancel or amend your booking in accordance with the provider’s cancellation or amendment policy, you will be charged a cancellation or amendment fee by the accommodation or other service provider. Further details of cancellation policy are set out in our email to you confirming your booking and are also shown on the hotel’s room details page prior to you making a booking. If you book directly with the accommodation provider it is their cancellation policy that you are then bound to comply to.

If, for whatsoever reason, you do not turn up at the accommodation on the arrival date stated on your booking confirmation email, without prior warning to Placestostayincardiff.co.uk  (“a no show”), this shall be considered a cancellation.

Where you request our special photography service for Accommodation advertiser/provider, you agree that we may provide your contact information to our photographer for the purpose of scheduling a visit to your property.

We are the data controller for the purpose of the Data Protection Act 1998 and we will be bound by the Privacy Policy in relation to the storage and use of your personal data.

 

What personal information do we collect?

In general, we use the information we collect about you to help our accommodation advertisers/providers provide accommodation solutions to users of our site, provide information services to relevant third parties, improve the features and services we offer and support our own marketing and promotion efforts.
